Ksa issues binding instruction to slot supplier Endorphina over games on illegal Dutch sites

The Dutch regulator has used a binding instruction against a B2B game supplier, Endorphina, rather than an operator. The order signals that suppliers serving licensed European markets now face scrutiny over where their content ends up.

The Kansspelautoriteit (Ksa) has issued a binding instruction to slot developer Endorphina, covering its Maltese and Cypriot entities. The board found the companies did not take adequate steps to keep their games off websites that are illegal in the Netherlands.

That failure promoted unlicensed gambling, which breaches Article 1(1)(b) of the Betting and Gaming Act (Wet op de kansspelen). The Ksa had announced its intention to issue the instruction in July and in September. It also published a separate decision on making the order public, under the same date as the instruction itself.

Endorphina games kept appearing on unlicensed Dutch-facing sites

Inspectors using Dutch IP addresses found Endorphina titles on illegal sites between January and February. Follow-up checks in June found its games on 19 websites. According to the supplier, it tightened its arrangements with distribution partners and brought in preventive restrictions in July 2026.

Those measures did not clear the problem. Across January to September, the games appeared on at least 28 different unlicensed sites, NEXT.io reported.

Endorphina disputes the finding and says it is only a B2B supplier that does not offer gambling to players itself. Its case rests on two further points. First, its Maltese entity serves the licensed Dutch market and, in the company’s view, should fall outside the instruction. Second, there is no proof it knowingly supplied illegal operators. The Ksa rejected the first point, finding that the distinction between the entities did not matter.

Suppliers selling into licensed markets face closer scrutiny

The case extends Dutch enforcement up the supply chain. On 22 October 2026, three days after the Endorphina decision was dated, the Ksa fined EOD Code SRL for illegal gambling offered in the Netherlands through several websites, including Instantcasino and Skyhills. That record €37m penalty targeted the operator side of the black market.

The Endorphina order targets the content feeding it. In the UK, the Gambling Commission reached a settlement with Evolution over supplying unlicensed sites. Together, the two cases point to regulators examining not only who offers games to players, but who supplies them.

For suppliers, the practical lesson is that holding a licence in a regulated market may not shield a group whose games surface elsewhere. The Ksa treated Endorphina’s corporate structure as irrelevant to the question of where its slots were playable. Distribution agreements and downstream monitoring are now part of the compliance picture.

Within six weeks, Endorphina can lodge an objection to the decision. Doing so will not pause its obligation to comply.
