New casino in Atlantic City Judge decides that the PILOT law breaches Atlantic County’s cooperation order.

According to a ruling issued Friday by Superior Court Judge Joseph Marczyk, the state breached the conditions of a 2018 consent decree with Atlantic County when it implemented a new casino payments-in-lieu-of-taxes law.

Marczyk did not enjoin the state from enacting the new PILOT statute “save to the extent that they are susceptible to sanctions and/or damages” that will be evaluated in a March hearing before Judge Michael J. Blee.

“What this means is that they’re going to decide now what damages we can collect and how we’ve been affected,” Atlantic County Executive Dennis Levinson explained.

No one from Gov. Phil Murphy’s office responded to a request for comment Friday afternoon.
