The Borgarting Court of Appeal confirmed that Norsk Tipping’s exclusive gambling rights model does not violate the EEA Agreement.
Currently, only Norsk Tipping may offer most forms of gambling in Norway, while Norsk Rikstoto has monopoly on horse racing.
Norsk Lottery AS filed the case in the Oslo District Court and Borgarting Court of Appeal in 2018, after applying for a gambling license. It also claimed that Norsk Tipping’s monopoly violated the EEA Agreement.
According to the European Free Trade Association, “the EEA Agreement guarantees equal rights and obligations for individuals and businesses in the EEA within the Internal Market.”
